LIMITED WARRANTY

BLADE Network Technologies Limited Warranty described in this document is only applicable to genuine BLADE Network Technologies products and supersedes any such information that may be contained within your BLADE Network Technologies product user documentation.

HARDWARE: BLADE Network Technologies warrants to the original end user (‘Customer’) that this hardware product will be substantially free from material defects in workmanship and materials, under normal use and service, for the following length of time from the date of purchase from BLADE Network Technologies or its authorized reseller:

TERMS: Hardware repair/replacement for 1 year

BLADE Network Technologies’ sole obligation under this express warranty shall be, at BLADE Network Technologies’ option and expense, to repair the defective product or part, deliver to Customer an equivalent BLADE Network Technologies product or part to replace the defective item, or if neither of the two foregoing options is reasonably available, refund to Customer the purchase price paid for the defective BLADE Network Technologies product. All BLADE Network Technologies products that are replaced will become the property of BLADE Network Technologies. Replacement products or parts may be new or reconditioned. BLADE Network Technologies warrants any replaced or repaired BLADE Network Technologies product or part for ninety (90) days from shipment, or the remainder of the initial warranty period, whichever is longer. BLADE Network Technologies is only responsible for the physical device and is not responsible for damages caused beyond the device. This warranty is applicable only to the physical hardware product.

WHAT THIS WARRANTY DOES NOT COVER:

BLADE Network Technologies is not authorized to provide software support on devices the product is inserted into with the exception of BLADE Network Technologies devices. Any other manufacturer’s device software incompatibility with the product is the responsibility of the customer. The warranty is only applicable to the hardware product. Failure or damage resulting from misuses, accident, modification, unsuitable physical or operating environment, or improper maintenance or failure to follow installation and handling instructions sent with the product will void the warranty. Any removal or alteration of identification labels will void the warranty. Any technical or other support provided for the product under warranty, such as assistance for set-up and installation is provided without warranties of any kind. BLADE Network Technologies does not warrant uninterrupted or error-free operation of the product. Ordering errors are not covered by warranty.

OBTAINING WARRANTY SERVICE: Customer must contact BLADE Network Technologies at http://www.bladenetwork.net and select the Support tab within the applicable warranty period to obtain warranty service authorization. Dated proof of purchase from BLADE Network Technologies or its authorized reseller may be required. BLADE Network Technologies will contact the customer and attempt to diagnose and resolve the problem over the telephone or electronically. A Return Material Authorization (RMA) number will be issued if the problem cannot be resolved remotely by way of software download for the switch the product is connected to. RETURNS: RMA instructions and forms are provided to the customer via email. No return is processed without first obtaining a RMA number. For return of defective product the customer must package appropriately the product and send it back via a freight agent of its choice to BLADE Network Technologies repair center. The RMA number must be visible on the outside of the package. By default the customer will receive a replacement unit once the repair center has established that the defect is covered by the warranty. Returned BLADE Network Technologies products are insured and sent by a method that provides for tracking of the package. Advanced replacement of the defective product is available only as an option. In this case the customer buys a replacement unit with payment by credit card through a secured site and is refunded the full amount of the replacement unit once the returned defective product is received by BLADE Network Technologies repair center and qualifies under the warranty terms. If the product returned does not qualify for warranty BLADE Network Technology will notify the customer and no refund will be issued. In all cases, if no-fault is found on the returned product the customer may be charged a restocking and transaction fee of 20% of the price of the product. Replacement unit are installed by the customer, no field engineering service is provided. BLADE Network Technologies will retain risk of loss or damage until the new item is delivered to Customer. The allocation of responsibility for loss or damage stated shall be subject to any mandatory legal requirements.

BLADE Network Technologies shall not be responsible for any software, firmware, information, or memory data of Customer contained in, stored on, or integrated with any BLADE Network Technologies products returned to BLADE Network Technologies for repair, whether under warranty or not.

EXTENDED WARRANTY: Within 90 days from the date of purchase the customer may purchase additional warranty beyond the initial first year warranty. This extended warranty cover the product for one additional year or two additional years after the end of the initial product warranty. The terms of the extended warranty are the same as the one for the initial first year warranty. The payment of the fee associated with this extended warranty validates the extended warranty and provide access to this service.

SOFTWARE: BLADE Network Technologies warrants to Customer that each BLADE Network Technologies software program licensed from it, except as noted below, will, if operated as directed in the user documentation, substantially achieve the functionality described in the user documentation for a period of ninety (90) days from the date of purchase from BLADE Network Technologies or its authorized reseller. No updates or upgrades are provided under this warranty. BLADE Network Technologies’ sole obligation under this express warranty shall be, at BLADE Network Technologies’ option and expense, to refund the purchase price for the BLADE Network Technologies software product or replace the BLADE Network Technologies software product with BLADE Network Technologies software which meets the requirements of this warranty as described above. Customer assumes responsibility for the selection of the appropriate programs and associated reference materials.

BLADE Network Technologies makes no warranty or representation that its software products will meet Customer’s requirements or work in combination with any hardware or software products provided by third parties, that the operation of the BLADE Network Technologies software products will be uninterrupted or error free, or that all defects in the BLADE Network Technologies software products will be corrected. For any third party products listed in the BLADE Network Technologies software product documentation or specifications as being compatible, BLADE Network Technologies will make reasonable efforts to provide compatibility, except where the non-compatibility is caused by a “bug” or defect in the third party’s product or from use of the BLADE Network Technologies software product not in accordance with BLADE Network Technologies published specifications or user manual.

THIS BLADE NETWORK TECHNOLOGIES PRODUCT MAY INCLUDE OR BE BUNDLED WITH THIRD PARTY SOFTWARE. THE WARRANTY PROVISIONS OF THIS DOCUMENT DO NOT APPLY TO SUCH THIRD PARTY SOFTWARE. IF A SEPARATE END USER LICENSE AGREEMENT HAS BEEN PROVIDED FOR SUCH THIRD PARTY SOFTWARE, USE OF THAT SOFTWARE WILL BE GOVERNED BY THAT AGREEMENT. FOR ANY APPLICABLE WARRANTY, PLEASE REFER TO THE END USER LICENSE AGREEMENT GOVERNING THE USE OF THAT SOFTWARE.

WARRANTIES EXCLUSIVE, WARRANTY DISCLAIMER: TO THE FULL EXTENT ALLOWED BY LAW, THE FOREGOING WARRANTIES AND REMEDIES ARE EXCLUSIVE AND ARE IN LIEU OF ALL OTHER WARRANTIES, TERMS OR CONDITIONS, EXPRESS OR IMPLIED, EITHER IN FACT OR BY OPERATION OF LAW, STATUTORY OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, WARRANTIES, TERMS OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SATISFACTORY QUALITY, CORRESPONDENCE WITH DESCRIPTION, NON-INFRINGEMENT AND QUIET ENJOYMENT, ALL OF WHICH ARE EXPRESSLY DISCLAIMED. BLADE NETWORK TECHNOLOGIES NEITHER ASSUMES NOR AUTHORIZES ANY OTHER PERSON TO ASSUME FOR IT ANY OTHER LIABILITY IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE OR USE OF THIS BLADE NETWORK TECHNOLOGIES PRODUCT.

BLADE NETWORK TECHNOLOGIES SHALL NOT BE LIABLE UNDER THIS WARRANTY IF ITS TESTING AND EXAMINATION DISCLOSE THAT THE ALLEGED DEFECT OR MALFUNCTION IN THE BLADE NETWORK TECHNOLOGIES PRODUCT DOES NOT EXIST OR WAS CAUSED BY CUSTOMER’S OR ANY THIRD PERSON’S MISUSE, NEGLECT, IMPROPER INSTALLATION OR TESTING, UNAUTHORIZED ATTEMPTS TO OPEN, REPAIR OR MODIFY THE BLADE NETWORK TECHNOLOGIES PRODUCT, OR ANY OTHER CAUSE BEYOND THE RANGE OF THE INTENDED USE, OR BY ACCIDENT, FIRE, LIGHTNING, POWER CUTS OR OUTAGES, OTHER HAZARDS, OR ACTS OF GOD.

BLADE NETWORK TECHNOLOGIES SHALL NOT BE LIABLE UNDER THIS WARRANTY IF THE PRODUCT IS NOT A GENUINE BLADE NETWORK TECHNOLOGIES PRODUCT. BLADE NETWORK TECHNOLOGIES DOES NOT ACCEPT, REPAIR OR REIMBURSE FOR RETURNS OF PRODUCTS THAT ARE NOT GENUINE BLADE NETWORK TECHNOLOGIES PRODUCTS.

LIMITATION OF LIABILITY: TO THE FULL EXTENT ALLOWED BY LAW, BLADE NETWORK TECHNOLOGIES ALSO EXCLUDES FOR ITSELF AND ITS LICENSORS AND SUPPLIERS ANY LIABILITY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF ITS PRODUCTS, EVEN IF BLADE NETWORK TECHNOLOGIES OR ITS AUTHORIZED RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND LIMITS ITS LIABILITY TO REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE PAID, AT BLADE NETWORK TECHNOLOGIES’S OPTION. THIS DISCLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL FAIL OF ITS ESSENTIAL PURPOSE.

Some countries, states, or provinces do not allow the exclusion or limitation of implied warranties or the limitation of incidental or consequential damages for certain products supplied to consumers or the limitation of liability for death or personal injury, so the above limitations and exclusions may be limited in their application to you. When the implied warranties are not allowed to be excluded in their entirety, they will be limited to the duration of the applicable written warranty. This warranty gives you specific legal rights which may vary depending on local law.

GOVERNING LAW: This Limited Warranty shall be governed by the laws of the California, U.S.A., and by the laws of the United States, excluding their conflicts of laws principles. The United Nations Convention on Contracts for the International Sale of Goods is hereby excluded in its entirety from application to this Limited Warranty.
